Mandate

The Anti-Corruption Act was assented last year on 31st March and it consists of 8 parts, 85 sections and numerous sub-sections which gives it the authority to investigate, detect and prevent corrupt practices.

This includes:
  • Abuse of position of trust
  • Interfere with witnesses
  • Unlawful gratification
  • Unexplained wealth
  • Election rigging
  • Biddings
  • Embezzlement 
  • And much more.

How strong is this act?
Search Warrants - Section 55(3)
Following an issued warrant from a judge or magistrate, the CEO or an officer of ACCS may access and remove any records and documents relating to the work of any public or private body.

Enter and search, at any time, the premises of any public or private body or any vessel, boat or aircraft, where the CEO or an officer of ACCS has reasonable grounds related to corrupt practices or corruptly acquired.

Order Arrests - Section 57(1)
The CEO or an officer of ACCS, upon having reasonable grounds, may request any police officer to arrest a person without a warrant.

Seizing Property - Section 58(1)
The CEO or an officer of ACCS, upon having reasonable grounds, may request a warrant to seize any movable or immovable property.
